Privacy Policy
1. Introduction
This Privacy Policy describes how CIPHERSWIFT SOLUTIONS (OPC) PRIVATE LIMITED (“we”, “us”, “our”) collects, uses, shares, protects, and otherwise processes personal information through the InstaDM service available at aipatnam.com (the “Service”).
You may be able to browse certain sections of the Service without registering. The Service is intended for use in India, and personal information may primarily be stored and processed in India.
By visiting the Service, providing information, connecting an account, or using the Service, you agree to this Privacy Policy, the Terms of Service, and applicable laws of India. If you do not agree with this Privacy Policy, please do not use or access the Service.
2. Information we collect
We collect personal information when you register for, access, or use the Service, or otherwise communicate with us. Depending on how you use the Service, this may include:
- Name and account information.
- Email address and contact information.
- Information needed to authenticate and maintain your account.
- Information about the Instagram account you choose to connect to the Service.
- Instagram content and data made available to the Service through the Instagram Graph API, such as posts, comments, and messages, to the extent required to provide the features you use.
- Information about your use of the Service, preferences, and interactions with the Service.
- AI credit balances, purchases, actions, and model token counts when you use a paid AI feature.
- Transaction or payment information if paid features are introduced and you choose to use them. Payment credentials may be processed by the applicable payment provider rather than stored directly by us.
When you choose an AI action, we briefly keep its generated text so a network retry can return the same result without charging you again. We remove that text after seven days, while keeping the credit and token usage record for billing and support. Deleting your account removes the generated text immediately.
You may choose not to provide information where it is optional, although doing so may prevent you from using particular services or features.
3. How we use information
We may use personal information to:
- Provide, operate, maintain, and improve the Service.
- Connect and operate the Instagram account and features you authorize.
- Process and deliver replies, direct messages, campaigns, and other actions requested by you.
- Authenticate accounts and maintain account security.
- Provide customer support and respond to requests.
- Detect, prevent, and investigate fraud, abuse, security incidents, or unlawful activity.
- Resolve disputes and enforce our Terms and other policies.
- Analyze aggregated or de-identified usage information to improve the Service.
- Comply with applicable legal obligations and lawful requests.
- Send service-related communications and, where permitted, marketing communications with an option to opt out.
4. Instagram and Meta data
InstaDM uses the Instagram Graph API. When you connect an Instagram Business or Creator account, you authorize the Service to access and process the data and permissions made available by Meta for the features you use.
We use such information only as reasonably necessary to provide and improve the Service, maintain security, comply with law, and perform the actions you request. Your use of Instagram remains subject to Meta’s applicable terms and policies.
5. Sharing of information
We may share personal information with service providers, technology providers, business partners, and other third parties where reasonably necessary to operate the Service, provide support, process payments where applicable, maintain security, or perform services on our behalf.
Sub-processors. To run specific features we send limited data to the following providers, only for the purpose described:
- Amazon Web Services (Amazon Bedrock) — runs AI comment sentiment, message rewrites and account summaries on Amazon’s Nova models. Public comment text (truncated), message drafts you ask us to rewrite and aggregated metrics may be sent for analysis. Commenter usernames and account credentials are not sent. Requests start in AWS Mumbai (India). Floating Ask AI uses Nova 2 Lite and may process your prompts, recent AI conversation, and selected catalog or campaign details in AWS regions worldwide. Other AI features may process data in AWS Asia-Pacific regions. AWS processes this data on our behalf and does not use it to train models.
- PhonePe — payment processing and UPI AutoPay mandates.
- Hosting and database providers — storage and delivery of the Service.
We may also disclose information to government authorities, law-enforcement agencies, courts, regulators, or other authorized parties when required by applicable law or when we reasonably believe disclosure is necessary to comply with a legal process, protect rights or safety, prevent fraud or abuse, or enforce our Terms.
If a third-party service provider collects information directly from you, its own privacy policy may also apply. We encourage you to review the privacy policies of third-party services before providing information to them.
6. Security precautions
We adopt reasonable security practices and procedures designed to protect personal information from unauthorized access, disclosure, loss, misuse, alteration, or destruction. However, no method of transmission or storage over the internet can be guaranteed to be completely secure.
You are responsible for maintaining the confidentiality of your login credentials and for notifying us promptly of unauthorized access to your account.
7. Data deletion and retention
You may request deletion of your account and associated personal information by using available account settings or by contacting us at privacy@aipatnam.com.
What deleting your account does. Any active subscription and its UPI AutoPay mandate are cancelled first. We then delete your connected Instagram accounts and everything stored for them (messages, contacts, campaigns, automations and insights), your sign-in methods and sessions, and your shop listings. Products you listed in the store are unpublished.
What we keep, and why. Records of payments, subscriptions and store orders are kept because tax and accounting law requires it, and because buyers and sellers in the store rely on them. They stay attached to an anonymised account record without your name, email address or password, which can never be signed in to again.
We may retain certain information where necessary to comply with legal obligations, resolve disputes, enforce agreements, prevent fraud or abuse, maintain security, or protect our legal rights. We retain personal information for no longer than reasonably necessary for the purposes for which it was collected, unless a longer period is required or permitted by law.
Some information may remain in backups for a limited period before it is securely deleted or overwritten. Where appropriate, information may also be retained in anonymized or aggregated form for analytics and research.
8. Your rights
Subject to applicable law, you may request access to, correction of, or updates to your personal information. You may also request deletion or raise concerns about our processing of your personal information by contacting us at privacy@aipatnam.com.
9. Consent and communications
By providing personal information and using the Service, you consent to the collection, use, storage, disclosure, and other processing described in this Privacy Policy, subject to applicable law.
We may contact you by email or other communication channels for service-related purposes. Where marketing communications are sent, you may opt out using the applicable unsubscribe mechanism or by contacting us.
You may withdraw consent where processing is based on consent by contacting us at privacy@aipatnam.com. Withdrawal will not affect processing already carried out lawfully before withdrawal and may affect our ability to provide features that require the withdrawn permission.
10. Third-party links and services
The Service may contain links to or integrations with third-party websites and services, including Meta’s platforms. When you use a third-party service, you may be subject to that provider’s terms and privacy policy. We are not responsible for the privacy practices of third parties.
11. Advertising and cookies
If we enable advertising on public pages, we may use Google AdSense. Google and its advertising partners may use cookies or similar technologies to show, limit, measure, and personalize ads based on visits to this and other websites. We do not place Google ads in the logged-in InstaDM product area.
Visitors can learn about how Google uses information from sites and apps that use its services at Google's partner-sites policy. Where consent is required by applicable law, we will provide the required choices before serving personalized advertising.
Link-in-bio pages. A creator’s link-in-bio page (store.aipatnam.com/ <username>) may load the creator’s own Meta Pixel and/or Google Analytics, if the creator has added their ID. The creator controls that tracking and is responsible for it; when a page uses it, the page says so, and Meta and Google then process your visit under their own policies. For every link-in-bio page, aipatnam itself only keeps anonymous daily counts — views, link clicks, the referring website, device type (mobile, tablet or desktop) and country. We do not store your name, IP address, cookies or browser details for these counts, and we delete the counts after 400 days.
12. Changes to this Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our services, information practices, or applicable requirements. The Effective date at the top of this page indicates the latest revision. Where required, we will provide notice of significant changes.
